1. About ClickTrack
ClickTrack is a platform for adults to connect through shared schools, participate in school communities, exchange messages and discover products or services offered by other members. It is operated by Smudge Colour (PTY) Ltd trading as Smudge Technologies, registration number 2012/140667/07, at 1st Floor, 139 Greenway, Greenside, Johannesburg, Gauteng, South Africa. General enquiries and complaints: info@smudge.co.za.
2. Eligibility and your account
You must be at least 18 years old to register. Give accurate account information and describe your school connections honestly. Keep your password confidential and tell us promptly if you suspect unauthorised use. Do not impersonate another person, falsely claim a school connection, or use another person’s account without authority.
3. School connections and recognition
You can join more than one school community and describe your connection as a former student, parent or staff member. School listing approval is an administrative decision about the listing. Recognition or a verification tick reflects a member’s recognition of a school connection. It is not an identity, qualification, employment, safeguarding or supplier-background check. A school listing, founder crown or verification tick does not itself establish school endorsement.
4. Community participation
Use ClickTrack lawfully and follow the Community Guidelines. Do not harass, threaten, discriminate, defame, scam, send unwanted promotions, publish another person’s private information without a lawful basis, or upload material you have no right to use. Do not scrape member information, build external contact lists, bypass access controls or interfere with the service. Only invite people when you have a lawful basis to use their details; invitations must not be used for bulk marketing.
5. Your content and our limited permission
You keep ownership of content you create. You must have the rights and any permissions needed to share your text, photographs and other content. You give ClickTrack a non-exclusive, royalty-free permission, including necessary processing by service providers, to store, reproduce, resize, display and distribute that content only as needed to operate the features you use, deliver it to its intended audience, maintain backups, moderate reports and meet legal obligations. This does not authorise sale of your content for unrelated advertising. Following removal, processing is limited to copies still required for those purposes, including lawful retention and content already delivered to other participants.
6. Business listings and member arrangements
Members are responsible for the accuracy of their professional information and offerings. Check the identity, credentials, pricing and suitability of a supplier before transacting. Members agree their own contracts, prices, payments and delivery arrangements. ClickTrack does not guarantee a member’s products, services, earnings, responses or business opportunities and is not automatically a party to arrangements made between members. This does not remove any legal responsibilities that apply to ClickTrack itself.
7. Messages, notifications and visibility
School-community content is available to the relevant community audience. Profiles and directory information are visible according to the platform’s school-access rules. Private messages are delivered to conversation participants. Reporting a conversation makes the relevant report snapshot, including available photos, accessible to authorised reviewers. Deleting a message from your view does not delete the other participant’s copy. Privacy and notification settings are described in the Privacy Policy.
8. Moderation, restrictions and complaints
We may investigate reports, remove content, restrict features or suspend accounts where reasonably necessary to address rule breaches, security, safety, fraud or legal duties. Reports and requests for review are managed by ClickTrack’s Super Admin and Smudge Technologies as the platform operator. They have final authority over internal moderation decisions, subject to applicable law and users’ statutory rights.
If you believe a decision is wrong, contact info@smudge.co.za with the relevant account or content details and your reasons for requesting review. Where appropriate, we will explain the reason and allow a response; urgent protection or legal requirements may require immediate action. An internal decision does not prevent a complaint to a regulator or recourse to a court. Moderation does not guarantee every item has been reviewed or is accurate.
9. Service operation and your legal rights
Features may be maintained, changed or interrupted. We do not promise uninterrupted availability or that member-provided information is complete. Nothing in these Terms excludes liability that cannot lawfully be excluded, removes mandatory consumer or privacy rights, or exempts liability for gross negligence where prohibited. Smudge Technologies may obtain external legal advice when needed to assess legal and compliance matters.
10. Closing accounts, changes and governing law
You can request account closure or deactivation by emailing info@smudge.co.za from your registered email address. We may need to verify your identity before acting. Deactivation makes an account inactive; it does not itself delete its information. Permanent closure and deletion are handled as explained in the Privacy Policy, including lawful retention and copies already shared with others.
We aim to complete ordinary account-closure requests within 60 calendar days of submission, and sooner where reasonably practicable or required by law. This target does not extend a shorter statutory deadline or delay urgent protective action. We may need to verify your identity and will explain any lawful retention or limitation.
These Terms are governed by South African law, subject to mandatory rights that apply to you. Material changes will be notified through the platform or account email as appropriate, with renewed acceptance where required.
